deemed to be extinct, and should be totally abolished: and whereas the Loans guaranteed by the said recited Acts were duly raised, and the Money arising thereby paid to the Use of the Government of Austria: and whereas a separate Account has hitherto been kept at the Bank of England of the Annuities payable by virtue of the said recited Acts, under the Title "Imperial Annuities:" and whereas it is no longer necessary that the said Account should be kept separate, and it is expedient that the same should be consolidated with and made a part of the Three Pounds per Centum Consolidated Annuities: May it therefore please Your Majesty that it may be enacted: and be it enacted by the King's Most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, that the separate Accounts of the Annuities called "Imperial Annuities," payable under the said recited Acts, which have heretofore been kept at the Bank of England, shall cease and determine, and the said Annuities, and the annual charge thereof, shall be deemed, from and after the passing of this Act, to be part of the Funded Debt of the United Kingdom of Great Britain and Ireland, and the said Annuities shall be, and the same are hereby, consolidated with the Three Pounds per Centum Consolidated Annuities payable at the Bank of England; any thing in the said recited Acts of the 35th and 37th Years respectively of the Reign of His late Majesty King George the Third, to the contrary thereof, in anywise notwithstanding.

II. And whereas it was agreed between the Commissioners of His Majesty's Treasury of the United Kingdom of Great Britain and Ireland, and the said Houses of Baring, Brothers, Reid, Irving, and Company, and Nathaniel Mayer Rothschild, that the said total Sum of £2,500,000 to be advanced by them on behalf of the Emperor of Austria should be paid in the several Proportions and at the Periods hereinafter mentioned; videlicet, £100,000 on the 1st day of December, 1823; £200,000 on the 1st day of August, 1824; £300,000 on the 1st day of April, 1825; £300,000 on the 1st day of December, 1825; £300,000 on the 1st day of August, 1826; and £1,300,000 on the 1st day of June, 1827; and it was provided that the said Parties should be entitled to a Discount at the Rate of £5 per Centum per Annum on any

Payments which they may make into His Majesty's Exchequer in anticipation of any of the said Instalments; Be it therefore further enacted, That upon the Payment of the whole of the said Sum of £2,500,000, or any part thereof, into the Exchequer, to be there carried to the Account of the Consolidated Fund of the United Kingdom of Great Britain and Ireland, before the same would be due and payable according to the said Agreement, it shall be lawful for the said Commissioners of His Majesty's Treasury, or any Three or more of them, by any Warrant under their Hands, to direct the Issue out of the growing Produce of the Consolidated Fund of such a Sum by way of Discount, in conformity with the aforesaid Agreement, as shall be equivalent to the Interest, at the rate of £5 per Centum per Annum, on any Sum or Sums which may have been paid by the said Parties before the same were due and payable according to the Terms of the said Agreement.

WHEREAS a Treaty of Perpetual Union, League, and Confederation, was concluded and signed in the City of the Freemen of Lima, between the

El Gobierno de la República de Colombia por una parte, y por otra del Estado del Perù, animados del mas sincéro deseo de poner prontamente un tèrmina à las calamidades de la presente Guerra, á que se han visto provocados por el Gobierno de S. M. C. el Rey de España; cooperando eficazmente à tan importante, objeto con todo su influjo, recursos, y Fuerzas Marítimas y Terrestres, hasta asegurar para siempre á sus Pueblos, Subditos, y Ciudadanos respectivos, los preciosos goces de su tranquilidad interior, de su Libertad é Independencia Nacional: y habiendo S. E. el Libertador, Presidente de Colombia, conferido al efecto Plenos Poderes al Honorable Sr. Joaquin Mosquera, Miembro del Senado de la República del mismo nombre; y el del Estado del Perù, al Ilustrisimo Honorable Señor Coronel D. Bernardo Monteagudo, Consejero y Ministro de Estado y Relaciones Exteriores, Fundador

Republic of Colombia and the State of Peru, on the 6th of July, 1822, by means of Plenipotentiaries fully authorized on both sides: the tenor of which Treaty is word for word as follows:

IN THE NAME OF GOD, THE SUPREME GOVERNOR OF

THE UNIVERSE.

The Government of the Republic of Colombia on the one hand, and that of the State of Peru on the other, animated with the most sincere desire of speedily terminating the calamities of the present War, into which they have been provoked by the Government of His Most Catholic Majesty The King of Spain; and desiring to co-operate effectually in this important object, with all their influence, resources, and Forces by Sea and Land, until the precious enjoyment of their internal tranquillity, their Liberty and National Independence, be secured for ever to their respective People, Subjects, and Citizens: and His Excellency the Liberator and President of Colombia, having with this view, conferred Full Powers on the Honorable Sr. Joaquin Mosquera, Member of the Senate of the above-named Republic; and the State of Peru having conferred like Powers on the Honorable Colonel D. Bernardo Monteagudo, Counsellor and

1. La República de Colombia y el Estado del Perù, se unen, ligan y confederan, desde ahora para siempre, en Paz y Guerra, para sostener con su influjo, y Fuerzas Marítimas y Terrestres, en cuanto lo permitan las circunstancias, su Independencia de la Nacion Española, y de cualquiera otra Dominacion Estrangera, y asegurar despues de reconocida aquella, su mutua prosperidad, la mejor armonìa y buena inteligencia, así entre sus Pueblos, Súbditos y Ciudadanos, como con las demas Potencias con quienes deben entrar en relaciones.

2. La República de Colombia y el Estado del Perú, se prometen por tanto, y contrahen espontaneamente, un Pacto perpetuo de alianza íntima y amistad firme y constante, para

1. The Republic of Colombia and the State of Peru do unite, league and confederate, from this time forward for ever more, in Peace and War, to sustain with their influence, and Forces by Sea and Land, as far as circumstances may permit, their Independence of the Spanish Nation, and of every other Foreign Dominion and to secure, after the recognition of their said Independence, mutual mutual prosperity, perfect harmony, and good understanding between their People, Subjects, and Citizens, as well as with such other Powers as may enter into

relations with them.

2. With this view, the Republic of Colombia and the State of Peru, do voluntarily engage in, and contract with each Other, a perpetual Treaty of intimate Alliance and firm

su defensa comun, para la seguridad de su Independencia y Libertad, para su bien reciproco y general, y para su tranquilidad interior; obligandose a socorrerse mutuamente y á rechazar en comun todo ataque ó invasion que pueda de alguna manera amenazar su Existencia Politica.

3. En casos de invasion repentina, ambas Partes podran obrar hostilmente en los Territorios de la Dependencia de una ú otra, siempre que las circunstancias del momento no den lugar á ponerse de acuerdo con el Gobierno á quien corresponda la Soberania del Territorio invadido. Pero la parte que asi obrase, deberà cumplir y hacer cumplir los Estatutos, Ordenanzas y Leyes del Estado respectivo, en cuanto lo permitan las circunstancias, y hacer respetar y obedecer su Gobierno.

Los

gastos que se hubiesen impendido en estas operaciones, se liquidaràn por Convenios separados, y se abonaràn un ano despues de la presente Guerra.

4. Para asegurar y perpetuar del mejor modo posible la buena amistad y correspondencia entre ambos Estados, los Ciudadanos del Perù y de Colombia gozaran de los derechos y prerogativos que corresponden á los Ciudadanos nacidos en ambos Territorios:

and lasting friendship, for their common defence, the security of their Independence and Liberty, their mutual and general good, and fortheir internaltranquillity; binding themselves to succour each other, and to repel, in common, any attack or invasion, that may in any way threaten their Political Existence.

3. In cases of sudden inva

sion, both Parties may engage in War in the Territories of either Party, should the exigency of the moment not afford time to communicate with the Government to which the invaded Territory may belong. But the Party thus acting shall observe and cause to be observed, the Statutes, Ordinances and Laws of the invaded State, as far as circumstances may permit, and shall cause its Government to be respected and obeyed. The expenses that may be incurred in these Operations shall be arranged by separate Conventions, and shall be settled within one Year after the present War.

4. In order to perpetuate and secure, in the best possible manner, a lasting friendship and good understanding between both States, the Citizens of Colombia and Peru shall enjoy the Rights and Prerogatives which belong to native born Citizens of ei
