1790 Tipoo Sultaun, having engagements with the Motif Contracting powers, has nothwithstanding, acted de l'al with infidelity to them all; for which reason they have united in a league, that, to the utmost of their power, they may punish him, and deprive him of the means of difturbing the general tranquillity in future.

This undertaking being refolved on it is agreed, Forces that, on Mr. Mallet's annunciation to Puudit Pur. Pour en daun, of the actual commencement of hoftilities be- guerre, tween the Honourable Company's forces and the faid Tippoo, and on Captain John Kennaway's announcing the fame to the Nabob Affuf Jah, the forces of the faid Pundit Purdaun and Nabob Afluf Jah, in number not less than 25,000, but as many more, and as much greater an equipment as may be, fhall immediatly invade the territories of the faid Tipoo, and reduce as much of his dominious as poffible before and during the rains; and after that feason, the faid Pundit Purdaun and Nabob will feriously and vigoroufly profecute war with a potent army, well appointed and equipped with the requifite warlike apparatus.

On the faid two batalions joining the Maratta Cavalle Army, Pundit Purdaun agrees to allot 2000 horse to Pundit remain and act in concert with them. But in the Purd. event of urgent fervice, on which cavalry alone can be employed, 1000 of the faid cavalry may be detached thereon, 1000 remaining conftantly with the battalions; whofe pay will be defraved regularly, in

ready money, every month, in the army, or in Poona, at the opinion of Mr. Mallet.

ART. VI.

Agent. From the time of the faid battalions entering Pandit Purdaun's territories, an agent on the part of the faid Pundit Purdaun shall be ordered to attend the commander to execute fuch service as may occur.

one month from the time of their being demanded, by the shortest and safest route, with all expedition, to the place of their destination, to act with the Company's forces; but, fhould any fervice occur, practicable only by cavalry, they fhall execute it, nor cavil on the clause of "To act with the Company's forces." The pay of the faid cavalry to be defrayed monthly: by the Honourable Company, at the rate and on the conditions hereafter to be settled.

ART. VIII.

If, in the profecution of the war by the three mutuel. allies, the enemy fhould gain a fuperiority over

either, the other, fhall, to the utmost of their power, exert themselves to relieve the said party, and distress the enemy.

ART. IX.

Partage The three contracting powers having agreed to quetes, enter into the prefent war, fhould their arms be crowned with fuccefs in the joint profecution of it, an equal divifion fhall be made of the acquifitions of territory, forts, and whatever each circar or government may become poffeffed of, from the time of each party commencing hoftilities. But should the Honourable Company's forces make any acquifition of territory from the enemy, previous to the commencement of hoftilities by the other parties, thofe parties fhall not be entitled ro any fhare thereof. In the general partition of territory, forts etc. 'due attention fhall be paid to the wishes and con

venience of the parttes relatively to their respective 1790 frontiers.

ART. X.

The underwritten Polygars and Zemindars, being Polydependant on Pundit Purdaun and Nabob Afsuf Jah; Zemin. it is agreed, that, on their territories, forts etc. fal- dare, ling into the hands of any of the allies, they fhall be reestablished therein; and the nuzzerana that shall be fixed on that occafion fhall be equally divided amongst the allies. But, in future, Pundit Purdaun, and the Nabob Alluf Jah, fhall collect from the usual kundaia, and peifhcufh, which has been here. tofore annually collected; and should the said Polygars and Zemindars act with infidelity towards Pundit Purdaun, or the Nabob, or prove refractory in the discharge of their kundnee and peifhcufh, the faid Pundit Purdaun and Nabob are to be at liberty to treat them as may be judged proper. The chief of Shanoor is to be fubject to fervice both with Pandit Purdaun and the Nabob; and should be fail in the usual conditions thereof, Pundit Purdaun and the Nabob will act as they think proper. To preserve, as far as poffible, confiftency and Agents concert in the conduct of this important undertaking, ques a vackeel from each party fhall be permitted to l'armée. refide in the army of the others, for the purpose of communicating to each other their refpective views and circumstances; and the reprefentations of the contracting parties to each other shall be duly attended to, confiftent with circumftances and the ftipu lations of this treaty.

ART. XII.

1790 its conditions at the verbal or written instance of any perfon or perfons whatever, or on any other pretence; and in the event of a peace being judged expedient, it shall be made by mutual confent no party introducing unreasonable objections; nor shall either of the parties enter into any feperate negociations with Tippoo; but, on the receipt of any advance or meffage from him by either party, it fhall be communicated to the others.

ART. XIII.

Guerres If, after the conclufion of peace with Tipoo, he futures. fhould attak or moleft either of the contracting parties, the others shall join to punish him. The mode and conditions shall be hereafter fettled by the three contracting powers.

ART. XIV.

Ratifi- This treaty, confifting of fourteen articles, being cation. this day fettled and concluded by Mr. Mallet, with the Peifhwah Suvoy Mahade, Narrain Pundit Purdaun Bahaudur, Mr. Mallet has delivered to Pundit Purdaun one copy of the fame, in English and Perfian, figned and fealed by himself, and Pundit Purdaun has delivered to Mr. Mallet another copy, in Maratta and Perfian, executed by himself; and Mr. Malled has engaged to procure, and deliver to Pundit Purdaun, in feventy-five days, a ratified copy from the Governor General, on the delivery of which the treaty excuted by Mr. Mallet fhall be returned. Poona, 1ft. June 1790.

Treaty of Offenfive and Defenfive Alliance between

the Honourable united English Eaft India Company, the Nabob Assuf Jah Bahaudur, Soubadar of the Dekhan, and the Peifḥwah Suyoy Mahadeu Narrain Pundit Purdaun Bahaudur- againft Futty Alli Khan, known by the Denomination of Tipoo Sultaun; fettled by Captain John Kennaway, on the Part of the faid Honourable Company, with the faid Nabob Affuf Jah, by virtue of the Powers delegated to him by the Right Honourable Charles Earl Cornwallis, K. B. Governor General in Council, appointed by the Honourable the Court of Directors of the faid Honourable Company to direct and controul all their Affairs in the Eaft Indies.
