1. (Compétence.) — L'action en réparation du

domniage causé par un abordage en pleine mer,

est de la compétence du tribunal du domicile du

défendeur, suivant la règle générale: les disposi-

tions des art. 435 et 436, C. comm., qui pre-

scrivent certaines réclamations et protestations à

faire en pareil cas au lieu le plus voisin de celui

où le sinistre est arrivé, n'emportent pas une attri-

bution spéciale de compétence au tribunal de ce

lieu. -2.503.

2. (Délai.)-Au cas d'abordage en pleine mer,

et par conséquent dans un lieu où le capitaine n'a

pu agir, et où, par suite, il n'a pu faire les récla-

mations prescrites par les art. 435 et 436, C.

comm., aucun délai ne court contre les proprié-

taires ou armateurs du navire abordé pour exercer

leur action en indemnité contre l'abordeur. -1.45.

3. Dans ce cas, si, à la suite du sinistre, le sort

du capitaine est resté inconnu, ses obligations n'in-

combent point aux autres officiers de l'équipage;

et on ne peut tirer une fin de non-recevoir contre

l'action des propriétaires du navire, de ce que ces

officiers n'auraient fait ni réclamations ni protesta-

tions aussitôt leur arrivée dans un lieu où ils pou-

vaient agir, ceux-ci ayant pu se croire dispensés

d'accomplir ces formalités, comptant que le capi-

taine les accomplirait lui-même. -1.45.

4. Peu importe que l'un des officiers qui n'était

pas le plus ancien, et qui, dès lors, ne remplaçait

pas de plein droit le capitaine, ait cru devoir faire

un rapport au consul de France aussitôt son arri-

vée dans un port de salut, ce rapport ne pouvant

faire considérer cet officier comme investi du pou-

voir et des obligations du capitaine. -1.45.

5. Toutefois, l'action de l'abordé doit être in-

tentée dans un délai moral, dont il appartient aux

tribunaux de mesurer l'étendue.-1.45.

6. Les dispositions des art. 435 et 436, C.

comm., qui subordonnent l'action en indemnité

pour cause d'abordage à certaines conditions ou

formalités préalables, notamment à la condition que

le demandeur ait formé une réclamation dans les
