Done at Lucknow, on the 1st of May, 1816, corresponding with the 2nd of Jemmadge Sanee, 1231 Hejree. No. 38.-TREATY with the Rajah of Siccim.-Titalya, 10th February, 1817. Treaty, Covenant or Agreement, entered into by Captain Barre Latter, Agent on the part of His Excellency the Right Honourable the Earl of Moira, K.G., Governor-General, &c. &c. &c., and by Nozir Chana Tingin, and Macha Timbah, and Lama Deechin Longdoo, Deputies on the part of the Rajah of Sikhempattee, being severally authorized and duly appointed for the above purposes. ART. I. The Honourable East India Company cedes, transfers and makes over in full Sovereignty to the Sikhempattee Rajah, his Heirs or Successors, all the hilly or mountainous Country situated to the Eastward of the Meetchie River, and to the Westward of the Tustah River, formerly possessed and occupied by the Rajah of Nepaul, but ceded to the Honourable East India Company by the Treaty of Peace signed at Sejowlee. 11. The Sikhempattee Rajah engages, for himself and Successors, to abstain from any acts of aggression or hostility against the Gorkahs, or any other State. III. That he will refer to the arbitration of the British Government any disputes or questions that may arise between his Subjects and those of Nepaul, or any other neighbouring States, and to abide by the decision of the British Government. IV. He engages, for himself and Successors, to join the British Troops with the whole of his Military Force, when employed within the Hills, and in general to afford the British Troops every aid and facility in his power. V. That he will not permit any British Subject, nor the Subject of any European or American State, to reside within his Dominions without the permission of the English Government. VI. That he will immediately seize and deliver up any Dacoits or notorious Offenders that may take refuge within his Territories. VII. That he will not afford protection to any Defaulters of revenue, or other Delinquents, when demanded by the British Government, through their accredited Agents. VIII. That he will afford protection to Merchants and Traders from the Company's Provinces; and he engages that no duties shall be levied on the transit of merchandize, beyond the established custom, at the several Golahs or Marts. IX. The Honourable East India Company guarantees to the Sikhempattee Rajah, and his Successors, the full and peaceable possession of the tract of hilly Country specified in the Ist Article of the present Agreement. X. This Treaty shall be ratified and exchanged by the Sikhempattee Rajah, within 1 month from the present date; and the Counterpart, when confirmed by His Excellency the Right Honourable the Governor-General, shall be transmitted to the Rajah. Done at Titalya, this 10th day of February, 1817, answering to the 9th of Phagoon 1873 Sumbhut, and to the 30th Maugh, 1223 Bengallee. SEPARATE and Secret Articles to the Treaty with the Nizam Hydrabad.-12th October, 1800. SEPARATE and Secret Articles, appertaining to the Treaty of Perpetual and General Defensive Alliance, concluded between the Honourable English East India Company and His Highness the Nawaub Asoph Jah Behauder, on the 12th October, Anno Domini 1800, or 22nd Jemmadee-ul-Awul, Anno Hegiræ 1215.* ART. I. The Peshwa, Rao Pundit Purdhaun shall be admitted to the benefits of this general Defensive Alliance on the following Conditions: 1st. Rao Pundit Purdhaun shall accept the mediation of the Honourable Company's Government, for the amicable adjustment, on the basis of the Treaty of Mah, of all claims or demands of Choute, and of all other claims or demands whatever, on the Territories or Government of His Highness the Nabob Asoph Jah. The British Government will also take into consideration the Claims of His Highness the Nabob Asof Jah to a total exemption from Choute, and will arbitrate, on the principles of justice and equity, any question now existing, or which shall hereafter arise, relative to the same, between Rao Pundit Purdhaun and the Nabob Asoph Jah, provided Rao Pundit Purdhaun shall agree to accept the said Arbitration; and Rao Pundit Purdhaun shall not be admitted to the benefit of this general Defensive Alliance, until he shall have agreed to accept the Arbitration of the British Government, with respect to the said Claims of the Nabob Asoph Jah to a total exemption from Choute. 2nd. Rao Pundit Purdhaun shall give full satisfaction to the Ho* See Page 180. nourable East India Company, on the various points depending between him and the British Government in India. 3rd. If Rao Pundit Purdhaun shall agree to the foregoing Conditions, the Honourable East India Company and His Highness the Nabob Asoph Jah will assist him in the restoration of his just authority in the Mahratta Empire. 4th. For this purpose, Rao Pundit Purdhaun shall agree to subsidize, in perpetuity, such a Body of the said Company's Troops, as shall hereafter be judged necessary for the restoration and maintenance of his authority. II. Rajah Rhagojee Bhooslah shall be admitted to the benefit of this General Alliance on the following Conditions: 1st. Rajah Rhagojee Bhooslah shall accept the Honourable Company's Arbitration of all unadjusted points between His Highness the Nabob Asoph Jah and the said Rajah, according to the tenour of subsisting Treaties. 2nd. Rajah Rhagojee Booslah shall agree to such equitable interchanges of Territory with the Honourable East India Company, as shall be judged necessary to complete or improve their respective Frontiers, or to such cessions of Territory (in consideration of a just pecuniary equivalent) as shall be judged necessary to the same purpose. III. If, contrary to the spirit and object of this Defensive Treaty, War should hereafter appear unavoidable (which God avert!) the Contracting Parties will proceed to adjust the rule of partition of all such advantages and acquisitions as may eventually result from the success of their united Arms. The Contracting Parties entertain no views of conquest or.extension of their respective Dominions, nor any intention of proceeding to Hostilities, unless in the case of unjustified or unprovoked aggression, and after the failure of their joint endeavours to obtain reasonable satisfaction, through the channel of pacific Negotiation, according to the tenour of the preceding Treaty. It is however declared, that in the event of War, and of a consequent partition of Conquests between the Contracting Parties, His Highness the Nabob Asoph Jah shall be entitled to participate, equally with the other Contracting Parties, in the division of every Territory which may be acquired by the successful exertion of their united Arms, provided His Highness the Nabob Asoph Jah shall have faithfully fulfilled all the Stipulations of the preceding Treaty, especially those contained in the XIIth and XIIIth Articles thereof.
